The Process of a Contested Divorce Case

The process of a Contested Divorce can go many different ways, and it is important to have an experienced Contested Divorce Lawyer help you create a strategy for success in your case.  There are strategic advantages to being the first to file for divorce, and you will need to consider where you file carefully.  After filing, you must have your spouse served with notice of the divorce petition, which can sometimes be a difficult process.  In many cases, after this is done, it is appropriate to have a Temporary Orders hearing so that the judge can hand down temporary guidelines until the case is finalized--including temporary child custody orders, temporary child support orders, and temporary orders regarding any property owned by the parties.  In many cases, the judge will also order the parties to Mediation.  If the case becomes extremely contested, it may also be appropriate to go through a process call "Discovery" to get valuable information from your spouse so that you can find information about what assets they are trying to hide, what activities they have engaged in, and other important information.  The ending point for Contested Divorces is typically a Final Hearing, at which time the judge will issue a Divorce Decree that details what happens regarding property division, child custody, child support, visitation, and other important issues.
